Being the organization belonged to the Government, the General Department of Customs performs the function of State management regarding the field of customs, the implementation of the State management system on customs throughout the country.

The General Department of Customs is responsible for conducting the tasks defined in the Ordinance on Customs dated february 20th, 1990 and the following concrete tasks and powers :

• 1. To draw up and submit to the Government juridical drafts (laws, ordinances), policies, systems and other legal documents on customs management. To organize the implementation of the above-said documents after their approvals are acquired.
• 2. To submit to the Government strategies, planning, plans regarding the field of the jurisdiction of customs. To organize the implementation of such strategies, planning when the approvals of the Government are acquired.
• 3. To direct, to manage, to control the implementation of customs activities, to collect export, import duties and other kinds of fees according to the regulations of the Government; to control, fight against contraband; to conduct customs statistics.
• 4. To submit to the Government the participation in international and regional customs organizations. To conduct international co-operation regarding customs according to the regulations of the Government.
• 5. To organize and to direct the implementation of the research and application of scientific - technological progresses in the field of customs.
• 6. To submit to the Prime Minister the organizational planning of customs network, standards, policies, responsibility system applied to customs officials, cadres.
• 7. To manage customs organization, officials, cadres, customs material basis according to the regulations of the Government.
• 8. The Head of the General Department of Customs has rights to issue decisions, orders, ordinances to perform the State management on customs, to implement the rights according to Articles 25, 26, 27 of the Law on organization of the Government dated September 30th, 1992.

Vietnamese customs is organized according to the following system :

• - In central: The General Department of Customs belongs to the Government.
• - In provinces, cities belonged to the central and inter -provinces :

  Departments of Customs belonged to the General Department of Customs. Based on the planning of customs network approved by the Prime Minister, at border gates, international sea ports, post offices serving foreigners, control areas of customs in borders, sea shores, river ports, territorial waters, areas next to territorial waters, export processing zones border gate customs teams or customs controlling teams may be established, who will work under the leadership of the Department of Customs.

  The establishment, dissolution, merge of provincial, inter -provincial Departments of Customs must be approved by the Prime Minister according to the proposal of the Head of the General Department of Customs and appraisal of the Head of Minister - Chairman of the Department of Personnel and Organization of the Government.

  The establishment of border gate customs or customs controlling teams must be decided by the Head of the General Department of Customs according to the planning of customs network approved by the Prime Minister.
