THE MINISTER Of TRADE

In accordance with the Decree No. 95/CP of December 4th, 1993 issued by the Government on the functions, Responsibilities, Power and the organization of the apparatus of the Ministry of Trade.

Pursuant to Article 5 of the Decision No. 752/TTG of December 10th, 1994 by the Prime Minister of the Government on implementing commodity policy and management of Import - Export activities in 1995.

Based on the opinion of the Prime Minister of the Government stated in document No. 294/KTTH dated Jan. 19th, 1995.

DECIDES

Article 1 :

Promulgate " The list of goods prohibited to export and import" attached to this Decision.

Article 2 :

This list of goods shall be applied to all forms of exports, imports and will be valid from April 1st, 1995.

Article 3 :

The functional agencies under the Ministry of Trade and juridical persons, physical persons involving in export and import activities shall be responsible for the implementation of this Decision.

Article 4 :

This list replaces "The list of goods prohibited to export and import " issued in attachment to the decision No. 238/TM - XNK of March 24th, 1994 by the Ministry of Trade.

LIST Of GOODS PROHIBITED TO EXPORT, IMPORT
(ATTACHED TO THE DECISION NO.96/TM-XNK Of fEBRUARY 24TH, 1995 BY THE MINISTER Of TRADE)

I. Goods that are prohibited to export :

1. Arms, ammunition, explosive materials, military techniques equipment and effects.

2.. Antiquities.

3. Drug of all kinds

4. Toxic chemicals.

5. Wood logs, timber, preliminary processed wood of all kinds, rattan materials

6. Wild animals, precious and rare animals and plants.

II. Goods that are prohibited to import.

1. Arms, ammunition, explosive materials, military techniques equipment and effects.

2. Drug of all kinds

3. Toxic chemicals

4. Reactionary and depraved cultural products

5. fire crackers and children' toys that detrimentally influence personality education, social order and safety.

6. Cigarettes (except personal quantitative luggage)

7. Used consumer goods (except automobile with fewer than 12 seats, two wheel vehicles with motor engine, mobile property and personal quantitative luggage.)

8. Automobiles and other self - moving vehicles with reverse - steering wheel (including detached components and spare parts).

Note :

1. In the special cases, the exports and imports of goods as mentioned in the above list are subject to the permission in writing by the Prime Minister.

2. The prohibition of exports of wild animals in accordance with the environment protection requirements shall be jointly directed by the Ministry of forestry and the Ministry of Science, Technology and Environment in separate documents.

3. To avoid importing outdated technology, the import applications for second - hand complete technology and individual machinery are subject to guiding documents issued by the Ministry of Science, Technology and Environment after unifying opinions with ministries managing production and Ministry of Trade.

4. Having unified the opinion with the Ministry of Trade and the Ministry of foreign Affairs, the General Department of Customs will provide directions to implementation of Heading "Mobile property" specified at point II, 7.
