To issue hereby in connection with this Decree the price table for various types of land.

Price table for various types of land shall be determined as follows:

• 1. for agricultural land, forestry land, the land prices shall be determined for each category of taxable land and divided into 3 categories: plain, midland, and mountainous region.

• 2. for the rural residential area, land price shall be determined for each land category, and divided into 3 categories: plain, midland and mountainous region.

• 3. for the residential areas adjacent to cities, townlets, traffic junction and major land routes, commercial center's, tourist sites and industrial areas the land price shall be determined for each land category and divided into types.
  

  Land category for determination of land price of rural residential area, living area in the vicinity of city, communication center and main road, business area, tourist spot, industrial zone, shall be based on profitable potential, using value, position and reality land price in the local.

• 4. for the urban areas, the land price shall be determined for 5 categories in accordance with recently regulation of State. Each urban category comprises three or four types of streets, then each type of street is classified into four or fi ve different land locations. Classification of streets inside the city shall be determined mainly based on position, profitable abilities, level of completed infrastructure and listening to reality land price of each urban.
  

  Land position in each urban shall be based on profitable conditions and land price of each area in urban.

• 5. People's Committee of province, city under the central (hereafter called people's committee of province) shall be responsible for executing classification of land category of rural residential area, based on each urban category in ac cordance with recently regulation and reality conditions in local in order to decide type of street and position of land of town in local for determination land price.

Land price rented by foreign organization or individual or the enterprise with foreign invested capital, shall be applied to stipulation of Government.

• 1. Based on price table of Government, People's Committee of province to determine the price for each category for calculating tax in transferring the land use right, collecting land allocation money, leasing land, evaluating the asset whe n allocating land, compensating losses when claiming back land. Besides compensating losses when State claiming back land to use for purpose of national defense, state security, state benefit, public benefit, they are stipulated by other De cree of Government.
  

  In the case that in the same type of urban category but profitable abilities of land are different, level of completed infrastructure are different, local authority is allowed to apply readjustment of coefficient of table prices (K) from 0 ,8 to 1,2 times of price level in the same type of urban category, of type of street and position of land stipulated in table prices of urban area (table price of number 4 promulgated in connection with this Decree).

• 2. The land prices determined by the localities must not be lower than minimal price and must not be higher than maximum price of price table and coefficient promulgated in connection with this Decree.

• 3. In the case that land transferred by auction form, land prices are decided by People's Committee of province for each specific case.

People's Committee of province is allowed to readjust land prices which were stipulated in order to suit the reality, in the case that land price is fluctuated by having investment of infrastructure, having new industrial areas, commercial center, tourist sites.

Land price applied following: calculating tax in transferring the land use right, collecting land allocation money, leasing land, evaluating the asset when allocating land, compensating losses when state claiming back land arising for m 15, October, 1993, if it is not decided, it is applied in accordance with land prices decided by People's Committee of province promulgated in connection with price table of this Decree.

This Decree shall come into full force from the signing date and replaced Decree No.80/CP of Government dated 6, November, 1993.

Ministry of finance go with Ministry of Construction, General Department of Administrative land, Government Pricing Bureau for guiding, examining of implementation of this Decree.

Ministers, Heads of Ministries, ranking bodies, bodies under the Government, the Chairman of People's Committee of the province, city under central authority shall be responsible for the implementation of this Decree.
