DECISION Of THE DIRECTOR Of VIETNAM NATIONAL MARITIME BUREAUR ON ALLOCATION AND OPERATION Of ACTIVITIES BY REGISTRARS Of SEA - GOING VESSEL AND CREW

THE DIRECTOR Of THE VIETNAM NATIONAL MARITIME BUREAU

Pursuant to the Maritime Code dated June 30, 1990;
Pursuant to Decree No. 239/HDBT dated June 29, 1992 by the Council of Ministers on the establishment of the Vietnam National Maritime Bureau,
Pursuant to Decree No. 14/CP dated february 25, 1994 by the Government promulgating the Regulation on Registration of Sea-Going Vessels and Crew;
Considering the recommendation of the Head of Maritime Legislation Department;

DECIDES

Article 1
Now promulgate provisions on allocation and operation of activities by Registrars of sea-going vessels and crew belonging to the Vietnam National Maritime Bureau.
Article 2
The Registrars of sea-going vessels and crew belonging to the Vietnam National Maritime Bureau include:
- 1. The National registrar of sea-going vessels and crew:
  The National Registrar of sea-going vessels and Crew is located at the Vietnam National Maritime Bureau, 11 Vo Thi Sau, Hai Phong, controlled by the Maritime Legislation Department and directly led by the Director of the Vietnam National Maritime Bureau.
- 2. Local registrars of sea-going vessels and crew:
  - a The Northern Local Registrar of Sea-Going Vessels and Crew for provinces from Ha Tinh northward is located in Hai Phong city. temporarily controlled by the National Registrar of Sea-Going Vessels and Crew and directly led by the Director of the Vietnam National Maritime Bureau.
  - b The Central Local registrar of Sea-Going Vessels and Crew for from Quang Binh province to Phu Yen, Gia Lai provinces is located in Da nang city, temporarily controlled by the Da Nang seaport and directly led in term of professional skills by the Nationa l Registrar of Sea-Going Vessels and Crew.
  - c The Southern Local Registrar of Sea- Going Vessels and Crew for provinces from Dac Lac, Khanh Hoa southward is located in Ho Chi Minh City, controlled by the branch of the Vietnam National Maritime Bureau, and directly led in term of professional skills by the National Registrar of Sea-Going Vessels and Crew.
Article 3
- 1. Activities of National and Local Registrars of sea-going vessels and crew shall be carried out in accordance with the Maritime Code of Vietnam, the Government's Decree No. 14/CP of february 25, 1994, other related applicable legal documents and provisi ons of this Decision.
- 2. The heads of the Maritime Legislation Department, branches of Vietnam National Maritime Bureau and the Director of Da Nang seaport shall be responsible before the Director of the Vietnam National Maritime Bureau for organization and operation of regist rations of sea-going vessels and crew in the allocated regions.
Article 4
To unify the activities of registrars mentioned in Article 2 of this Decision, consideration for approval of certificates, licenses and records relating to registration of sea-going vessels and crew is determined as follows:
- 1. Leaders of the Vietnam National Maritime Bureau shall approve:
  - - Decisions to allow sea-going vessels owned by foreign organizations and individuals to register in Vietnam
  - - Decisions to allow sea-going vessels owned by Vietnamese organizations and individuals to register abroad
  - - Decisions to allow Vietnam's sea-going vessels to operate on international routes.
  - - Sea-going permits
  - - Sea-going vessel registration certificates.
  - - Seaman passport
  - - Maritime chief certificates of various kinds, categories.
  - - Professional certificates of various kinds, categories.
- 2. Leaders of the Maritime Legislation Department shall approve:
  - - Temporary registration certificates
  - - Decisions to approve ship naming
  - - Registration deletion certificates.
  - - Certification on mortgage, hypotheses and maritime lien.
  - - Seaman registry books
  - - Seaman books of local seamen.
  - - Extensions to seaman passports, changes of titles, ship names and names of masters in seaman passports.
  - - Minimum safe border location certificates.
  - - Certificates of IMO fee payment
  - - Shipping itineraries.
  - - Other certificates relating to ship, crew registration.
- 3. Leaders of branches of Vietnam National Maritime Bureau shall approve:
  - - Temporary registration certificates
  - - Decisions to approve ship naming.
  - - Sea-going permits.
  - - Registration deletion certificates.
  - - Certification on mortgage, hypotheses and maritime lien.
  - - Seaman registry books.
  - - Seaman books of local seamen.
  - - Extensions to seaman passports, changes of titles, ship names and names of masters in seaman passports.
  - - Minimum safe border location certificates.
  - - Certificates of IMO fee payment
  - - Shipping itineraries.
  - - Other certificates relating to ship, crew registration.
- 4. Leaders of Da Nang sea port shall approve:
  - - Temporary registration certificates.
  - - Decisions to approve ship naming
  - - Sea-going permits.
  - - Registration deletion certificates
  - - Seaman registry books
  - - Seaman books
  - - Certification of mortgage, hypotheses and maritime lien.
  - - Minimum safe border location registration.
  - - Certificates of IMO fee payment
  - - Shipping itineraries.
  - - Other certificates relating to ship, crew registration.
Article 5
This decision takes effect as from the date of signing.
The office director, heads of departments, branches of Vietnam National Maritime Bureau, the Director of Da Nang sea port and heads of related agencies are responsible to execute this Decision.
