NOTIfiCATION ON
SUPPLEMENTARY GUIDANCE fOR SEAPORT CHARGES
- Pursuant to the Decree No 01/CP dated 5 January, 1993 of Government providing tasks, powers and organisation of the Pricing Commission of the Government.
- Pursuant to the interministerial Circular No 02/TTL dated 12 April, 1993 of the Pricing Commission of the Government - the Ministry of Transport and Communication Providing the management of the seaport charges.
- On proposal of the Vietnam Maritime Department Stated in the official document No 2842/KHDT on supplementary seaport charges applicable to foreign means of shipping and having consulted with the Vietnam Maritime Department.
- The Government Price Committee guides and provides supplementary issues concerning seaport charges as follows:
I. SEAPORT CHARGES APPLICABLE TO fOREIGN MEANS Of SHIPPING (EXTERNAL CHARGES)
- 1. Charges for maritime guarantee:
- 1.1. foreign means of shipping in buoy - zero position or in position waiting for pilotage to receive oil, fresh water or change seamen (without coming in port and going out) shall be figured out at 30 per cent over the rate of charges for maritime guaran
tee as stipulated in paragraph 3 part II concerning the seaport charge table of the Decision No 20/VGCP-CNTDDV.
- 1.2. foreign means of shipping arriving in buoy thresh position at Vung Tau territorial waters to receive oil, fresh water or change seamen (without coming in port and going out) shall be figured out at 50 per cent over the rate of charges for maritime g
uarantee as stipulated in paragraph 2, part II concerning the seaport charge table of the Decision No.20/VGCP-CNTDDV.
- 2. Wharf charge applicable to passengers as stipulated in paragraph 2.2, part III concerning the seaport charge table of the Decision No 20/VGCP-CNTDDV shall be figured out for one-time coming in or one-time going out as follows:
- In-turn : USD 2/turn-person
- Out-turn : USD 2/turn-person
- 3. Charge for shooting rubbish applicable to lines:
Any lines moored to piers, buoys, road steads gulfs which have the need of shooting rubbish at least once daily shall be figured out for rubbish shooting charge in accordance with the following price list (including means of rubbish transportation).
- 3.1. Anchorage at piers:
- a) Popular charge : USD 10 per cubic metre
- b) In the case where means of water ways are used to carry out the shooting of rubbish, the charge may be raised at most by 50 per cent over that popular one as stipulated in paragraph a above.
- 3.2. Anchorage at buoy, roadsteads, gulfs: USD 18 per cubic metre
- 3.3. In the case where ship-owners or the body in charge of epidemic control demand that the rubbish be incinerated or buried then the charge applicable to this service shall be agreed upon by the ship-owners and the establishments which deal with provisi
on of services.
- 4. To supplement a goods item named round wood (in the log) into group 3 of charge table applicable to the handling of goods (equivalent to 4 times) over the handling charges as stipulated in paragraph 1, part IV concerning the seaport charge table of the
Decision No20/VGCP-CNTDDV.
II. SEAPORT CHARGES APPLICABLE TO DOMESTIC MEANS Of SHIPPING (HOME CHARGE)
- 1. In the case where foreign countries charter Vietnamese ships to carry freight, in their trips the ships shall moor to Vietnamese Seaport (without handling cargo) with just maritime reasons, then home charges shall be applicable to these ships.
- 2. In the case where foreign countries charter Vietnamese ships to carry freight, in their trips the ships shall moor to Vietnamese seaports to deliver the imports without loading the exports, then the charges shall be:
- - In-turn : External charges shall be applicable
- - Out-turn : Home charges shall be applicable
- 3. In the case where foreign countries charter Vietnamese ships to carry freight, in their trips the ships shall moor to Vietnamese seaport to load the exports without delivering the imports, then home charges shall be applicable to in-turn and external c
harges shall be applicable to out-turn.
- 4. Duration of time for calculating piers and wharves charges.
- 4.1. In the case where Vietnamese ships come in the port to deliver inland freight or the ships are run without freight to the ports for being loaded with the exports, during the time when the shipments have not taken place yet (starting from the point of
time when the ships arrive in the ports), the home charges shall be applicable to them. for the duration starting from the point of time when the shipments take place to the point of time when the ships depart the port, external charges shall be applicab
le.
- 4.2. In the case where Vietnamese ships deliver the imports, external charges shall be applicable for the first port where they arrive in starting from the point of time when the ships arrive in the ports to the point of time when the shipments of imports
are ended.
III. ORGANIZATION Of IMPLEMENTATION
- 1. This notification shall come into full force and effect from 15 April, 1994. All contracts concluded before 15 April, 1994 shall be settled as follows: The quantity of work already completed before 15 April, 1994 shall be conform with the charges state
d in the contracts, the quantity of work completed after 15 April, 1994 shall be conform with the regulations stated in this notification.
- 2. Any impediments or new services occur during the process of implementation of this notification shall be reported to the pricing Commission of the Government and the Vietnam Maritime Department for further settlement.
