REGARDING THE GRANTING Of THE TRADING RIGHT TO IMPORT COMPLETE EQUIPMENT

In implementation of Decision number 91/ TTg of 13 November 1992 by the Prime Minister regulating the management of the import of machinery and equipment through use of State Budget capital, on 30 July 1993, the Ministry of Trade issued Circular number 04 /TM-DT instructing the materialization of the above - mentioned Decision number 91-TTg.

Though the practical implementation over the last six months, in order to ensure the perfect materialization of Decision number 91-TTg of 13 November 1992, the Ministry of Trade hereby wishes to add some guidance supplementary to a few points of Circular number 04/TM-DT of 30 July 1993 as follows:

1/ The consideration for granting to business enterprises the right to do business regarding the import of complete equipment as specified in Articles 4 and 5 of Circular 04/TM-DT shall be carried out in the fourth quarter of 1994 and from 1 January 1995 only enterprises entitled to do business regarding import of complete equipment can conduct business operation in this field.
from now on till 1 January 1995, the business operation regarding import of complete equipment shall be carried out by business enterprises entitled by the Ministry of Trade to do business regarding machinery and equipment ( as specified in Article 3 of C ircular 04/ TM-DT)
2/ The following paragraph shall be added to Article 10 of Circular 04/TM-DT of 30 July 1993:" from now on all contracts for importing machinery and equipment, including both individual and complete equipment must contain an article specifying that: the contract shall take effect of implementation subject to the approval by the competent State agency".
With respect to contracts for importing individual equipment whose value of an unit of machinery is below 100,000 USD or the total value of the contract is below 500,000 USD, their articles shall be decided by the business enterprises themselves.
Other contents of Circular No 04/TM-DT of 30 July 1993 not mentioned in this supplementary document shall remain effective.
This supplementary document shall take effect of implementation from the date of its signing.
