Eliminating Corruption and Malfeasance; Promoting Ethical Government


1. Currently-enacted anti-corruption measures are being reviewed and the implementation of the "Promoting Ethical Government Ethics Program" (originally called the "Anti-orruption Program") is to be continued. (Agency in charge: Ministry of Justice [MOJ])

2. The mass media and various public forums are being utilized to express the government's determination in fighting corruption and encourage citizens to come forth with information on corrupt activities. (Agencies in charge: MOJ, General Information Office [GIO]) *agencies have equal reporting status

3. Personnel whose area of responsibility makes it easy to commit improprieties are being strictly investigated to determine whether or not they have in fact been guilty of accepting bribes, giving or receiving favors, or any other corrupt or malfeasant behavior; such offenses are being prosecuted vigorously. 4. "Matters to be Noted with Regard to Preventing Corruption During the Implementation of the Anti-corruption Plan" is being reviewed. Reasonable standards are being drawn up for extraordinary concern and involvement in administration, gifts given and received by civil servants, and banquets and other social affairs. Moreover, senior officials are being required to step up their supervision and investigation of the above matters. (Agency in charge: MOJ)

5. The results of enacting the "Law Governing the Reporting of Property by Civil Servants" are being reviewed and substantial audits of property reporting information are being strengthen in order to put an end to intentional false reporting. (Agency in charge: MOJ)

6. In order to actively prevent improper conduct, institutional factors leading to corruption and malfeasance are being studied and relevant laws and regulations will be amended or augmented as necessary. (Agency in charge: MOJ)

7. The anti-corruption organizational framework will be revised: the "Clean Government Board" established by the Executive Yuan has been made responsible for assessing and providing information on all of the R.O.C.'s policies for preventing and eradicating corruption. Furthermore, the organizational structure and sphere of responsibility of anti-corruption units are being examined and adjusted in order to enhance their functioning. (Agency in charge: MOJ)

8. Statutes governing the punishment of corruption will be amended: The behavior constituting "profit-seeking offenses" will be clarified, and this phrase will be changed to "resulting crimes." In addition, the punishments required in corruption cases will be lowered as appropriate, and the "Statute for Apprehending Bribery" will be re-instituted. (Agency in charge: MOJ)

9. Administrative procedures and guidelines are being studied and formulated in order to clarify the handling of extraordinary concern and involvement in administration and make administrative processes more transparent. (Agencies in charge: MOJ, RDEC)
